Victory! Or is it Victory? Jesse Willms Surrenders All to FTC Onslaught.

Jesse Willms Folds Following Consumer-Led Pressure on FTC and Other Law Agencies

Jesse Willms, (the Canadian who set the legal dogs, financed by his scamduggery, onto me, for telling the truth about him on this website), has finally caved in to the FTC charges.  This is the full FTC judgement.

This is a  victory of sorts for the millions who have been scammed by him over the last few years.  However, what has actually happened has been a kind of plea bargaining, much favoured in the US. (Here’s his home-town take on it.)

Instead of being stripped completely of his ill-gotten gains and being chucked in the slammer for a few years, he has reached a settlement whereby no admission of guilt has been made!

This is exactly what I suggested would happen, because the self-proclaimed philanthropist Jesse will do anything, absolutely anything, to stay in business.

To me this isn’t true victory.

The Return of Fu Manchu

He’s not been punished by the law which explains the lingering smell I have, possibly due to his key lawyers having previously worked at the FTC.  Maybe it is the old boy network?  Whatever.

The millions (yes, millions the FTC say) of people scammed may be temporarily amazed at the $359-million judgement, but seeing as how the original complaint was for over $450m they’ll soon realise that he’s got off with $100m!  However it’s worded, Willms has weaselled out of any admission of guilt, which means he’s still in business.

What cunning plans could now be afoot, with $100m to back them up, they’ll wonder?  It’s like The Return of Fu Manchu.

Willms’ Blog Release – notice how he promotes the $25k ‘gift’, but not his $359m settlement?

Like me, the millions scammed by him will be questioning how he isn’t, right now, being butt-plugged in Huntsville, instead of having 7 days to calmly surrender his bank accounts to prove that he can stump up the $359m negotiated, meanwhile making gratuitous comments about better business practices in future whilst still singing the praises of his $1000 philanthropic gestures.

  • True, Willms et al have to hand over all their money and have promised as much under sufferance of perjury.
  • True, they all have to notify the FTC of their whereabouts for the next 20 years and all their business proceeds.  They have to keep compliance records for 5 years.
  • True, Willms must tell the FTC his jobs, phone numbers, businesses in which he’s involved etc
  • True, Willms et al have 180 days to hand over all details of all their businesses and contacts within those businesses.
  • True, Willms for the next five years must give a copy of the FTC order (the pdf attached) to each person he does business with and that they have 30 days to sign and return it to the FTC.

True for all of that, but, Willms can still do business and who knows if any of his victims will get recompensed.  A lot of the order’s wording is to ensure that the US & Canadian Inland Revenue get their taxes from Willms et al for the last three years.  What about the little people?

This article guesses that victims won’t see any of the cash.  My guess is that only those people that actually complained to the FTC will get cash, which is why it’s so important to complain, as I’ve suggested for years.

The Return of Fu Manchu

This article thinks that he’s had to hand over everything (though I can’t see how they justify that, given what we know about business secrecy in Nicosia, Cyprus), yet it also points out that the bans that Willms has had to acquiesce to only apply to the USA!  That is, there’s nothing at all saying Willms can’t set up anywhere else, like Korea say, and hammer the world from there!

I, of course, beg to differ, because:

  • He settled with Microsoft, yet carried on trading as usual.
  • He settled with Symantech, yet carried on trading as usual.
  • He settled with Oprah Winfrey, yet carried on trading as usual.
  • He settled with Dr Oz, yet carried on trading as usual.
  • He settled with Google yet carried on trading as usual.
  • Now he has settled with the FTC. I’d be amazed (yet obviously pleased) if he changed the patterns of a lifetime. Only time will tell.

On top of this, Willms himself states on his blog entry (see screenshot above);

We are working to resolve issues relating to past marketing practices for products that our company no longer sells. Through this process, we have taken steps to assure(sic) that our business practices are in full compliance with the law. We are excited by the opportunity to continue giving customers access to a variety of products and services at significant savings. – n.b.  the emphasis is mine.

…..which looks to me that it’s more web business, not a change in business type.

It’s a victory, but not the one the whole world wants.  It all leaves a bad, lingering, smell…..

 Affected Businesses

Apart from Willms, Sechrist and others, the business entities that we’ve come across in our investigations here, are all in the judgement.  It writes that “Corporate Defendants” means:

  • 1021018 Alberta Ltd, also d..b.a. Just Think Media, Credit Report America, Wulongsource, and Wuyi Source;
  • 1016363 Alberta Ltd also d.b.a. eDirect Software;
  • 1524948 Alberta Ltd, also d.b.a. Terra Marketing Group, Swipe.Bids.com, and SwipeAuctions.com;
  • Circle Media Bids Limited, also d.b.a. SwipeBids.com SwipeAuctions.com, and SellofAuctions.com;
  • Coastwest Holdings Limited;
  • Farend Services Ltd;
  • JDW Media, LLC;
  • Net Soft Media, LLC, also d.b.a. SwipeBids.com;
  • Sphere Media, LLC, also d.b,a SwipeBids.com and SwipeAuctions.com;

I’ve listed these so that they appear in search engines and so that people realise the lengths of obfuscation that Willms has used in his activities.

Office Politics

I say Willms, because he is recognised in the judgement as the prime mover in the scams.  He has been pinched for hundreds of millions – the others have been collared for a few tens of thousands at most each, some, for nothing, because (how embarrassing is that for them?), they have nothing – yes really!

  • How annoying for the two Gravers that their payments are about the same as young Jesse Wilms’ fish tank!  ($30,000 in 2010 he paid for it)
  • I wonder how the Children’s Hospital Boston and the Gulf Coast Restoration Fund both realise that they’ve got less from philanthropic Jesse than he’s spent on his fish tank?  ($25k each)  I wonder how they feel now, knowing that this money was stolen from ordinary consumers, people like themselves?
  • Or how do Canadian veterans feel about Willms plugging his $1k donation to the poppy fund, while spending $5000 on a pool table?

How galling for Sechrist, Callister, and Milne.  They can pay nothing, Willms can pay $359m!  If they’re still working for him I bet that that’s fun in the office!

Pacific Webworks, Lawyers and Social Networking

Introduction

The last thing we need is more scummy scammers and following on from Google’s legal action against Pacific Webworks (PWW) one would naively have thought that the “business” folk would be more circumspect.  (See previous article and comments, http://strangelyperfect.tv/5146/more-on-google-profits-and-pacific-webworks/ )

At the beginning of June, it appeared that the Google case against PWW had fallen flat and that PWW had gotten away with it.  This certainly appears so from yesterday’s press announcement by the odious PWW management, such as here.  It says,

SALT LAKE CITY, Jun 28, 2010 (BUSINESS WIRE) — Pacific WebWorks, Inc.  today announced that a Stipulated Final Judgment and Order for Permanent Injunction was entered in the U.S. District Court for the District of Utah in the Google, Inc. vs. Pacific WebWorks, Inc. matter.

CEO Ken Bell commented, “We are very pleased to have this behind us. We have devoted a great deal of time and energy to resolving this situation and are anxious to return to the business of growing our company responsibly and profitably through our new marketing program. We appreciate our shareholders’ patience and understanding as we deal with the many details involved in the development and marketing of our products to small business users.”

Quite Bad

This looks quite bad until you realise that the PWW share price and dealing volumes have both fallen!

So what does the market know about the “settlement” that we don’t, eh?

Bloosky.com and The lawyer

PWW and Bloosky, were both named by Google, and Bloosky were (and still are) represented by Blair Jackson, who is a lawyer and on the company payroll of Bloosky in various positions.  (See at the bottom of here).

You can see this on some delaying action in the Google case by Jackson for Bloosky, documents here and here.  But it gets better…   In this document, you’ll see that Bloosky are suing someone called Daniel L. Balsam for not adhering to an earlier agreement not to disclose what was said… or something. (I’ve yet to check this through!  But it looks a bit like pot-kettle-black to me…)

Yes. Whatever.  A bit more fishing on Jackson took me to the website(s) of one Vernon Howard.

He was scammed by socialtoolkit.com, in  exactly the same way as thousands of others were by Google Treasure Chest – promoted, run, designed and financed by Pacific Webworks.  It’s a scammers paradise with copious bad-web references and complaints.   The “business” says on it’s website,

Each day, more and more individuals, small business owners and Fortune 500 companies across the globe are realizing the value of SocialToolKit.com and choosing to increase their Social Networking efficiency, productivity and profits.   (Note to self:  “I must increase my Social Networking efficiency” – SP)

Here’s Vernon’s extremely well written story:

It’s an incredibly detailed tale, complete with copious screenshots, of his dealings with the various parties involved.  And he’s no shrinking violet.  He’s taking the buggers on!

There’s only one trouble.

He’s using Blair Jackson of Christiansen & Jackson, PC – Attorneys at Law, to take on socialtoolkit.com !!

How is this Weird?

Weird?  It’s positively scary!

Because if you read Vernon Howard’s account, you’ll see that he was billed by  YourProfitGateway.com

YourProfitGateway.com, when you check it’s (now freely accessible) WHOIS, unsurprisingly redirects to http://www.visualwebtools.com/site/

If you’ve been following this, you’ll know from a while back that Visual WebTools is owned and run by…….. (trumpet fanfare)

Last Thursday, this is what the odious CEO Ken Bell of PWW said about his company, their marketing and their product, Visual WebTools.

Pacific WebWorks, Inc., www.pacificwebworks.com, (OTCBB:PWEB) announced today that the company continues to perfect their new marketing program which offers prospective customers the opportunity to receive a tutorial on the product and interact with the company during the buying process.

CEO Ken Bell stated,

“Visual WebTools continues to be one of the premier online software products for small businesses in the marketplace. We expect our new, more interactive marketing approach to result in a more informed buyer who will be better equipped to employ our technologies into their online business. As a result, we expect future revenues to be more stable. We anticipate revenues to accelerate during the second half of the year with continued profitability.”

Bell continued,

“During the first six months of 2010 (i.e. since Google sued them – SP the company has focused on stabilizing profitability, servicing current customers and developing our new multi-tiered marketing program. We expect new customer acquisition in the future to be derived largely from our new direct contact marketing program. With our strong balance sheet, a current ratio in excess of 10x, tangible book value of nearly double our current market capitalization and strong historical earnings, we are positioned to continue to take advantage of opportunities in the marketplace.”

What are Google Doing?

The emphasis above, is mine.  From it, you can clearly see that Bell claims that his company is responsible for all the things that lead up to the nefarious practices that then lead to people being scammed.

So is the Google thing over with yet?  Why haven’t the Salt Lake Tribune said anything about it yet?

I still think there’s more to come out with this.  Remember the falling share price of PWW?  The markets know, you know.

Fish Heads

It’s grief innit?

Consider this.
You care for someone dearly and they get ill and go on a life support machine. Now you are not a doctor and don’t know how the life support machine works.

Occasionally, the patient wakes up, says strange things, and then goes back into a coma on the life support machine….
You worry and worry, distraught with angst at your own inadequacies because you are unable to help this person…. remember, you are not a doctor.

After several years of this, the person wakes up, reaches across and says;

“There is no life support machine. It was all a dream concocted by myself to pass the time. Each time I woke up, only 10% of the things I said were true”.

Confused, you then think “This can’t be so?”…

Then the person gets up and throws a bucket of fish heads over you and then several thousand knives just like in the film “House of Flying Daggers”, many of which hit your eyes, heart and genitals.

That’s what it’s like. Grief, mate.

Bridgwater Kingfisher

I’ve just uploaded this video using different software and process so I don’t know how it’ll appear yet.  However, see if you can spot the kingfisher?

It’s a remarkable bird that I’ve been trying to catch on camera for ages.

  • When they’re stationary in trees they’re almost impossible to see.
  • When they fly, they are like a flash of blood and electricity across the gloaming.
  • When  they fly, they are impossible to track with a hand-held camera!
  • When they are in the trees they are impossible to see in the viewfinder!

Despite all this, my new Panasonic Lumix TZ7 has videoed the thing quite well!  For a few seconds, you actually can see the thing quite clearly – a first for me!  Woo-Hoo!  (You’ll have to double-click to get it full screen (or at least larger) to then see this on YouTube directly.

At 0:30 you’ll see it centre-frame and at ~1:00, just as I’ve got a true beamer on it – it shoots off down and right and then flew up the canal!  It’s what they do – like a woman, they just entice you in and then foom!  They’re gone!  Ha Ha.

(The TZ7 replaces the TZ5 which I carelessly dropped onto the tiled floor  at home)
